Mandatory Menstrual Leave May Risk Women’s Hiring, Says Supreme Court.

The Supreme Court of India has observed that making menstrual leave mandatory in workplaces could unintentionally affect women’s employment opportunities. During a hearing on a petition seeking compulsory menstrual leave, the court said that if such a rule is enforced across all organizations, some employers might hesitate to hire women due to concerns about productivity and workplace management.
The bench, headed by Chief Justice of India D. Y. Chandrachud, explained that while menstrual health and workplace support for women are important issues, a compulsory leave policy might lead to unintended discrimination in hiring. The court emphasized that any policy must be carefully designed so that it supports women without creating barriers to employment.
Government-Related Decisions:
The central government told the court that menstrual leave policies involve several social, economic, and workplace factors. Because of this, the government believes the issue should be addressed through policy discussions rather than a direct court order.
The Supreme Court of India suggested that the matter should be considered by the government and relevant authorities to study its impact and decide whether a nationwide policy is necessary. Currently, India does not have a national law mandating menstrual leave, although some private companies and organizations offer it voluntarily.
